Welcome to FemStyle AI (https://femstyle.ai). These Terms of Service ("Terms") govern your access to and use of our website, applications, and services (collectively, the "Service"). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

FemStyle AI is an AI-powered virtual try-on platform. You upload photos of yourself and items of clothing, and our service generates AI composites showing how the clothing might look on you. The Service is intended for personal, non-commercial exploration of fashion and style.

2. Eligibility and Age Restriction

You must be at least 18 years old to use the Service. By using FemStyle AI you represent and warrant that you are at least 18years of age. The Service is not intended for, and we do not knowingly collect information from, individuals under 18. If we learn that a user is under 18, we will terminate the account and delete all associated data.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information during signup and to keep it current. One person may maintain only one account unless we expressly permit otherwise.

4. Acceptable Use

You agree that you will not:

  • Upload photos of any person under 18 years of age;
  • Upload photos of any person without that person's explicit consent;
  • Upload sexually explicit, pornographic, or otherwise unlawful imagery;
  • Use the Service to create deepfakes, impersonate another person, harass, defame, or otherwise harm anyone;
  • Use the Service for hateful, discriminatory, or threatening purposes;
  • Attempt to reverse engineer, scrape, or extract the underlying AI models or source code;
  • Circumvent, disable, or otherwise interfere with security-related features of the Service, including rate limits and authentication;
  • Resell or redistribute the Service or access credentials without our permission;
  • Use automated means (bots, scripts) to access the Service at scale.

We reserve the right to investigate suspected violations and to suspend or terminate accounts that breach these rules, without refund.

5. Your Content and License to Us

You retain ownership of photos you upload and results generated for you ("Your Content"). By uploading Your Content you grant FemStyle AI a limited, worldwide, non-exclusive, royalty-free license to host, process, transform, and display Your Content solely to operate and provide the Service to you. This license ends when the content is deleted from our systems.

We do not use Your Content to train AI models, and we do not share Your Content with third parties except the processors strictly necessary to deliver the Service (see our Privacy Policy).

6. AI-Generated Output

The Service uses third-party generative AI models to produce try-on images. AI output is provided "as is" and may contain errors, distortions, or unexpected results.FemStyle AI makes no warranty that output will be accurate, realistic, suitable for any particular purpose, or free of defects. You are responsible for how you use and share AI output.

7. Femfit Credits, Plans, and Payments

The Service operates on a credit system called "Femfit". Each virtual try-on generation consumes one Femfit credit. New users receive six (6) Femfit credits free on signup. Additional credits can be obtained by subscribing to a paid plan.

Payments are processed by our payment provider (Lemon Squeezy). Subscriptions renew automatically unless cancelled before the renewal date. You can cancel your subscription at any time from your account settings; you will retain access until the end of the current billing period.

Refund policy: Femfit credits are non-refundable once consumed. Unused subscription time is non-refundable except where required by applicable law.

8. Termination

You may delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, create legal risk for us, or engage in behaviour that damages other users or the Service. Upon termination, your right to use the Service ends immediately.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FEMSTYLE AI AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE SIX MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold FemStyle AI harmless from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising from your misuse of the Service or violation of these Terms, including unauthorized uploads of third-party photos.

12. Governing Law

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in Ukraine for any dispute arising from these Terms, except where mandatory consumer-protection law grants you the right to sue in your country of residence.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top. Material changes will be announced via email or in-app notice. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
